How and where do I begin the eviction process?

The tenant then used a legal aid from a public-funded law firm to challenge our termination letter and threatened suing us. We had consulted several lawyers. Some of them were contradictory to each other. We became very confused and uncertain about how to proceed in evicting this tenant. Then, I called Eviction Service Center. They asked some simple questions and told me how to proceed.

We understand. You want your tenant to leave, and you have no idea where to start. You have come to the right place.

First of all, WHY do you want to evict your tenant? Does your tenant owe you rent? Did he violate the terms of the rental agreement? Did he move in unauthorized occupants? Does he have a dog? Does he owe you money for the utilities? Did his lease expire, and he’s still in the property? Is he a nuisance? Or do you simply want the property back for your own personal use?

Whatever the reason is that you are evicting your tenant, you must start by serving some type of notice. Here are a few examples of notices that can be served:

  •   3-Day Notice for Nonpayment of Rent

  •   30-Day Notice to Terminate Tenancy

  •   3-Day Breach of Contract Notice that required the tenant(s) to change their actions according to the terms of the lease

Keep in mind there are times when it is NEVER okay to evict a tenant… And as long as the reason you want to evict is not on this list, then you are ready to begin the eviction process.
